Terms of Service

1. Acceptance of Terms

By accessing or using Xenith.host (“Xenith Host”, “we”, “our”, or “us”), including purchasing or using any of our services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use our website or Services.

2. Services

We provide hosting services including:

  • Game server hosting
  • VPS / cloud servers
  • Web hosting

We may update, modify, or discontinue parts of the Services at any time.

3. Eligibility & Accounts

You must be at least 13 years old to use the Services. If you are under 18, you must have permission from a parent or legal guardian.

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • All activity occurring under your account
  • Keeping your account information accurate and up-to-date
  • Immediately notifying us of suspected unauthorized access

4. Billing, Payments, and Refunds

Billing: Services are billed in advance on a recurring basis (monthly, quarterly, annually, or as shown at checkout). Renewals may be automatic depending on your selected payment method.

Payment Methods: We accept payments via Creem.io, PayPal, and cryptocurrency (where available).

Refunds: Refunds are handled on a case-by-case basis at our discretion. Fees paid to payment processors, chargebacks, or network fees (e.g., crypto fees) may be non-refundable.

Non-payment: If payment is not received by the due date, Services may be suspended or terminated. We may provide a short grace period, but we do not guarantee data retention after suspension/termination.

5. Uptime & Maintenance

We aim for high availability, but we do not guarantee uninterrupted service. Scheduled maintenance may occur. We are not liable for interruptions caused by factors outside our reasonable control, including upstream network issues, attacks, software vulnerabilities, or force majeure events.

6. Acceptable Use (Abuse Policy)

You agree not to use our Services to:

  • Host, store, or transmit illegal content
  • Distribute malware, phishing, or other harmful software
  • Attempt unauthorized access to systems or networks
  • Launch or facilitate attacks (including DDoS) against any target
  • Spam or send unsolicited bulk messages
  • Infringe intellectual property rights
  • Host content harmful to minors or exploitative content
  • Mine cryptocurrency without explicit permission (if applicable)
  • Exceed resource limits, abuse shared systems, or bypass restrictions

Enforcement: We may suspend, null-route, restrict, or terminate Services immediately if we believe your usage creates risk, violates these Terms, triggers abuse complaints, or threatens our infrastructure or other customers.

7. User Content, Data, and Backups

You retain ownership of the content and data you upload (“User Content”). You grant us a limited license to host, store, and process User Content solely to provide the Services.

You are responsible for maintaining your own backups unless your plan explicitly includes backups. We are not liable for data loss or corruption, regardless of cause.

8. Suspension & Termination

By you: You may cancel through the billing panel. Cancellation typically takes effect at the end of the current billing period unless otherwise stated.

By us: We may suspend or terminate Services at any time for violations, non-payment, abuse complaints, legal requirements, or to protect our systems and customers.

Data deletion: After termination, User Content may be deleted after a short retention period. We do not guarantee the ability to restore data after suspension/termination.

9. Intellectual Property

Our website, branding, and platform content (excluding User Content) are owned by Xenith Host or licensors and are protected by applicable laws. You may not copy, modify, distribute, or reverse engineer our materials except as permitted by law.

10. Disclaimer of Warranties

Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Xenith Host shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, or business, even if advised of the possibility.

Our total liability for any claim shall not exceed the amount you paid us for the affected Service in the 3 months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold Xenith Host harmless from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.

13. Governing Law & Venue

These Terms are governed by the laws of Germany. Where legally permitted, disputes shall be resolved in the courts having jurisdiction in Germany. Nothing in these Terms limits consumer rights that cannot be waived under applicable law.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last Updated” date. Continued use of the Services after changes become effective means you accept the updated Terms.
